Community Guidelines

EverFans seeks to empower AI Creators, both by providing a Platform where AIG-Content and AI-powered creativity can thrive, and by providing unparalleled AI tools to make AIG-Content on the Platform. As part of empowering AI Creators, we are also dedicated to being a safe, respectful, secure and welcoming community for all Users. These Community Guidelines (\"Guidelines\") set out Mingle Minds AI Limited's ("Mingle Minds") expectations of how Users will conduct themselves in our community channels and in relation to other Users and Creators. These Guidelines apply to all Users and with respect to all aspects of our Services. By using our Services, you agree to comply with these standards in spirit as well as to the letter.

Framework

1) These Guidelines are part of Mingle Minds' broader Policies, including the Terms of Service, and Acceptable Use Policy.

2) Unless otherwise stated in these Guidelines, capitalised terms used but not defined in these Guidelines are defined in the Terms of Service.

Age requirements

3) You must be of legal age where you are located to use our Services, in accordance with our Terms of Service (Section 2).

Respectful communication

4) You must communicate respectfully with other Users and Creators. We do not accept, and will not tolerate, communications and Content that violate our Acceptable Use Policy or any of our Policies.

5) Prohibited communications include but are not limited to any form of discrimination, hate speech, terrorism, and extremism, whether explicit or implicit.

All Content: General

6) Your Content must comply with the law applicable in any locale from which it is Uploaded and from which it is accessible.

7) You must have the legal right to any User-Generated Content that you Upload to the Platform. This includes but is not limited to owning the relevant rights to or having a valid license to Upload the User-Generated Content.

8) AIG-Content must depict only yourself or depictions for which you have appropriate intellectual property and/or usage rights.

9) AIG-Content must not:

  • depict individuals under the age of 18.
  • impersonate or intend to impersonate individuals or likenesses of any kind, including public figures, private persons, or other Users. Parody or similar comedic devices that a reasonable person would understand as such are unlikely to breach this rule.
  • be insulting, threatening or hateful towards any identifiable natural person, or in any way contravene these Guidelines.
  • be harmful or misleading.
  • incite or encourage illegal activities.
  • depict graphic or excessive violence, obscene material, or self-harm, taking the relevant context into account (e.g., whether the Content includes newsworthy images or artistic/stylized representations).
  • re-Upload (in whole or in part) Content that we have previously declared to breach any of our Policies.

10) You are responsible for all harm that may be caused by your Content.

11) All Users of EverFans must be adults. If you learn or suspect that a minor has inappropriately accessed the Platform and/or your Content, please report this to [email protected].

12) Content must not depict or resemble a real person other than the account owner or someone who has given their explicit, documented consent.

13) "Deepfake" or "faceswapping" Content of any kind is strictly forbidden without the documented permission or granted rights from the individual(s) depicted and/or original content creator. Uploading content reasonably determined to be a deepfake is illegal, and we will take appropriate action against Users who Upload such Content, including but not limited to blocking the User and/or terminating the respective account.

14) For AIG-Content created via the AI tools in the Services, you are fully responsible for any input you provide and any output you receive based on your input.

15) AIG-Content must not depict or intend to depict persons under the age of 18, taking both the visual depiction and the context into account.

16) AIG-Content is subject to the rest of the rules in our Policies, including but not limited to requirements that Content does not infringe on anyone's intellectual property rights, does not impersonate anyone, and is not harmful or misleading.

Adult Content

17) Creators may Upload sexual and/or explicit AIG-Content ("Adult Content"), subject to these Guidelines and our other Policies.

18) Adult Content must be clearly marked as "Adult Content."

19) All depictions of persons (whether real or imagined) in Adult Content must be adults.

20) Anyone who holds intellectual property rights in Adult Content Uploaded to the Platform must be an adult.

Non-Consensual and Unsolicited Content

21) You may not Upload Content depicting or disclosing private information regarding an identifiable individual other than yourself, unless they have given you their documented consent. We strongly encourage all Users to refrain from sharing sensitive personal information on the Platform.

22) Publishing personal contact information or details about other persons (commonly known as "doxxing") is strictly forbidden. We will take appropriate action against Users who do so, including but not limited to permanent account suspension.

23) Publishing non-consensual intimate media ("NCIM", commonly referred to as "revenge porn") is a crime and is strictly forbidden. We have controls in place to ensure this does not happen, and we terminate accounts that we have confirmed Uploaded NCIM. If you believe that a User as Uploaded NCIM depicting you, please contact us at [email protected] with information that allows us to locate and investigate the NCIM you are reporting.

Moderation and monitoring

24) We have implemented robust trust and safety controls to ensure the safety of our users and integrity of our AI models. Conversations, requests, and/or outputs flagged by you, other Users, or our trust and safety controls as potentially violating any of our policies may be reviewed and appropriate action taken in response, up to and including account termination and banning.

25) We may also monitor communications as part of quality assurance and refinement of our Services.

Expected behaviours and conduct

27) Your use of EverFans is subject to our other Policies, in particular our Terms of Service and Acceptable Use Policy.

28) You are responsible for the actions taken with your account, whether such action is known or unknown by you and whether or not you have authorised such actions.

29) You must not use our Services to:

  • Breach any local, national or international law or regulation.
  • Harm or attempt to harm any individuals, including specifically minors.
  • Probe, scan, or test the vulnerability of any system or network.
  • Breach or circumvent security protocols or authentication systems.
  • Access or tamper with areas of the Services without authorisation.
  • Disrupt or interfere with any user, host, or network by sending viruses, flooding, or spamming, or sending any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.

  • Access or create accounts using methods other than publicly supported interfaces.

  • Send unsolicited communications, advertisements, or spam.

  • Provide inaccurate media or account information, including misleading or fraudulent Content.

  • Bypass storage limits.

  • Engage in any unlawful, fraudulent or illegal activity, including advocating, promoting or inciting any party to commit, or assist any unlawful or criminal act.

  • Create, or attempt to create, publish, or share, Content that may constitute child exploitation or illegal pornography.

  • Create, or attempt to create, share or promote Content that advocates extreme violence, terrorist activity, or terrorism-related propaganda.

  • Create, or attempt to create, share or promote Content that involves underage individuals, either directly or by manipulating the system to bypass detection.

  • Attempt to circumvent moderation controls or \"jailbreak\" the Services with the intent to create Content prohibited by these guidelines (e.g. Underage Content, and Content that may constitute child exploitation or illegal pornography etc).

  • Encourage hatred, bigotry, or violence against individuals or groups based on traits such as race, religion, gender identity, sexual orientation, disability, or other characteristics related to systemic discrimination. Infringe any rights, including intellectual property rights, of any person.

  • Infringe on the privacy or rights of others (e.g. by sharing or storing confidential or personal information without authorisation).

  • Frame, embed, or create mirrors of any Content from our site without prior written consent.

  • Threaten or abuse another person or behave in a way likely to harass, upset, embarrass, alarm or annoy any other person.

  • Impersonate any person or misrepresent your identity or affiliation with any person.

  • Depending on your jurisdiction, applicable law may require you to label any AI-generated content, including the Content, as such. It is your sole responsibility to ensure that you comply with such requirements.

Enforcing breaches

30) We reserve the right to determine, in our sole discretion, whether there has been or is likely to be a breach of these Guidelines or of any of our Policies, and what action to take in response to any such actual or likely breaches.

31) If we determine at our discretion that you may have breached, or are likely to breach these Guidelines in whole or in part, then we may, without limitation, take such action as we deem necessary, including:

  • Suspending, removing or restricting your access.
  • Commencing enforcement action against you.
  • Terminating your account.
  • At our discretion and if authorised by law or if required by law, reporting any breaches or any of your activities to the relevant government authorities.
  • Removing Content that violates any of our Policies, with or without notice to you.

32) While we may take appropriate action against User-Generated Content in order to maintain a safe and welcoming environment, Users are responsible for their own Content and actions on EverFans.
